Long Wait for Justice as Pendency in Rape Cases Mounts
NCRB data for 2024 shows that while annual rape cases have remained broadly stable since 2018, pendency in courts has steadily increased, with fewer than 2% of cases entering trial ending in conviction in the same year.
Trend in Rape Cases
- India reported 29,536 rape cases in 2024, compared with 33,356 in 2018.
- Since 2018, annual registrations have remained around 28,000–33,000 cases, averaging roughly 80 cases per day.
- The analysis excludes rape cases registered separately under the Protection of Children from Sexual Offences (POCSO) Act.
Investigation Stage
- Nearly 40,000 rape cases were taken up for investigation in 2024, including pending cases from earlier years.
- Around 25,000 cases (63%) were charge-sheeted, while others remained pending or were closed, transferred or disposed of at the investigation stage.
- About 8,905 cases remained pending investigation at the end of 2024.
Growing Trial Backlog
- Charge-sheeted cases entered an already large judicial backlog, taking the total trial pool to about 2.07 lakh cases in 2024.
- Nearly 90% of these cases remained pending at the end of the year.
- Pending rape trials increased from 1.39 lakh in 2018 to about 1.86 lakh in 2024.
Conviction and Disposal
- Courts disposed of around 20,587 rape cases in 2024.
- Of disposed cases, around 68% ended in acquittal, 8% in discharge and 24% in conviction.
- Only 421 cases that entered trial in 2024 resulted in conviction within the same year, illustrating the slow pace of justice.
- India’s overall conviction rate in rape cases remains below 30%.
Why is Pendency Rising?
- Fresh charge-sheeted cases continue to enter a judicial system already carrying a large backlog from previous years.
- Delays at both the investigation and trial stages prevent cases from being disposed of within prescribed timelines.
- Legislative reforms after the 2012 Nirbhaya case strengthened punishment and introduced timelines, but implementation remains weak.
